you see the cloud formations against the mountains and the skies are beautiful in rain or shine. This photo was taken from a cell on a gloomy day so the colors don't show up too well. However, normally you'll see desert sands, the rocks are pinkish bluish color and you see green bushes and cactus here and there. It's the serenity that makes it beautiful and the quietness. At night time you can only see dark skies with a bright moon and twinkling stars. It's a dreamers, writers, photographers, and artists paradise. Palm Springs is the place where Fred Astaire, Ginger Rogers, Frank Sinatra, Elvis Presley, Bob Hope and many visited or lived.&lt;div class="blogger-post-footer"&gt;&lt;img width='1' height='1' What the EPA does is if any company is in violation of the law, the EPA has authority to notify the state where the company is located, to give heavy fines and to notify the party being offended. The EPA has the right to sue, shut down or levy fine and even impose criminal penalties against the stakeholders involved. &lt;br /&gt;&lt;br /&gt;Furthermore, the EPA has to enforce the laws and procedures that are supposed to be done by each company. The ethical analysis here is rights and justice as the ethical concept, of the people working for the company and the people living and working outside of the company in the environment. Again, as I put in our debate posting, the environment is also a stakeholder. &lt;br /&gt;&lt;br /&gt;Finally, the main ethical concept to be concerned with here is moral rights. The people and the environment have the moral right to life and safety. People have the right to live and work in a safe environment. The EPA helps to enforce the laws, by giving fines, shutting down some businesses, as they are authorized to fine violators without having to go to court since 1990. In addition. Lawsuits can be given to private individuals. Therefore, the CEO and key personnel could be held liable. To this end, the EPA is important to our studies because they regulate so many different areas and it is a common factor in business having chemicals, and that is why it’s important to change the way business is run from the very beginning before it’s too late.  Otherwise, the end result would be failure for any company here or abroad. First, I would suggest that we hire our own two-man team Geologists to study the environment of the area we plan on purchasing and putting our plant.&lt;br /&gt;&lt;br /&gt; Second, it’s important to have clean water and hire someone in-house to check the pollutants, because there is no EPA in Mexico. All the more we have to check on the water, because if a child or adult got sick and died, the CEO and other stakeholders would be liable if the family decided to sue. Add to this, more importantly how would we feel morally losing someone and knowing it was our fault. Next, I need to make it clear that the environment is the main stakeholder here.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Third, not only the water but the land needs to be checked to be sure there are not already dangerous chemicals in the land prior to building.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Fourth, we have to be sure no one conceals the evidence, therefore by having an in-house auditor to audit the reports and files down the road. &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Fifth, as mentioned above have our Geologists check the soil but double check and we are sure there are not already some open reports somewhere.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Sixth, we have to have manuals printed with proper protocol for staff and employees because we are all stakeholders here. We will not be able to get investment funds in J/V deals if a leak gets out that there’s a problem in one of our plants. type='text'>My Discussion, Research on OSHA</title><content type='html'>First, workplace safety without OSHA would be very unsafe, because OSHA&lt;br /&gt;assures safety and healthful concerns for employees who are some of the&lt;br /&gt;stakeholders of the organization. Furthermore, they provide technical&lt;br /&gt;assistance to employers and employees in their programs that consult them.&lt;br /&gt;Plus, they stimulate management and employee commitment for a safe&lt;br /&gt;environment and improve working conditions by giving routine inspections&lt;br /&gt;(OSHA, 2009).&lt;br /&gt;&lt;br /&gt;Second, managers and company owners would be safety conscience to a certain&lt;br /&gt;extend. However, they will be more safety conscience if they knew that there&lt;br /&gt;were penalties, possible jail sentencing for knowingly causing harm to&lt;br /&gt;individuals in the workplace causing major injury or death (OSHA, 2009).&lt;br /&gt;&lt;br /&gt;Third, if an OSHA inspector came to the plant or company unannounced I would&lt;br /&gt;feel relieved to know that they are watching over companies. I would welcome&lt;br /&gt;the inspector with open arms.&lt;br /&gt;&lt;br /&gt;The reasoning behind all this is a positive view, because companies and&lt;br /&gt;employees need to know that there is regulation for their own protection.&lt;br /&gt;OSHA inspectors can inspect and find a flaw that can be corrected ahead of&lt;br /&gt;time before disaster hits and then it causes more damage to the company.&lt;br /&gt;There were 6.218 fatal injuries out of 17,000 injuries or illnesses for each&lt;br /&gt;day out of 6.2 million workers in 1998 alone. (Personally I recall an old&lt;br /&gt;friend of mine died from asbestos poisoning and he died before he even won&lt;br /&gt;in the lawsuit. In the old days the major plants had a lot of cases of&lt;br /&gt;asbestos poisoning and itâ€™s a slow cancer that hits the lungs and other&lt;br /&gt;parts of the body.) Furthermore, costs exceed $120bil a year, $60.9 bil in&lt;br /&gt;lost wages and productivity, $21.1 in medical costs and $23.7 for rehires,&lt;br /&gt;not to mention the pain and suffering the family goes through (OSHA, 2009).&lt;br /&gt;&lt;br /&gt;Still further, some companies think itâ€™s cheaper to ignore fixing a machine&lt;br /&gt;and have a casualty rather than preventing the casualty. There should be&lt;br /&gt;safety training in this case and preventative measures. Since the OSHA Act&lt;br /&gt;casualties have been cut in half. It is better to prevent a disaster than to&lt;br /&gt;have 25 men die from being trapped behind locked doors, company going BK and&lt;br /&gt;owner of Imperial getting 19 years in prison for not having safety features&lt;br /&gt;in place (OSHA, 2009).&lt;br /&gt;&lt;br /&gt;Finally, main issues should be to continue to enforce strong penalties, have&lt;br /&gt;more funding for more inspectors, and have better protection for&lt;br /&gt;whistleblowers. There should be an anonymous tip 800 line setup for&lt;br /&gt;whistleblowers to help investigators go after violators and managers need to&lt;br /&gt;have training programs in place for other managers and employees&lt;br /&gt;(stakeholders) and allow NO doctoring of documents. Plus, managers and&lt;br /&gt;company owners should continue to be held liable because they have an&lt;br /&gt;ethical and legal obligation to protect the company and its stakeholders.
